GetTrueCare Enterprises Inc, doing business as Prestige Wellness Company (“Prestige Wellness,” “we,” “us,” or “our”), is a Wyoming corporation operating a B2B healthcare technology platform and group purchasing organization. Prestige Wellness is not a pharmacy, medical practice, or clinical services provider. We do not prescribe, compound, dispense, or ship medications. All medication fulfillment is performed exclusively by licensed third-party 503A compounding pharmacies.

2. Eligibility

This website and the services described herein are intended exclusively for licensed medical clinics, healthcare practices, and their authorized representatives. Access to and use of the Prestige Wellness Platform requires execution of a separate Master Services Agreement and completion of our credentialing and KYC process. Nothing on this website constitutes an offer to provide services to any unlicensed party or to consumers.

3. Website Use

The following rules govern permitted and prohibited use of this website.

3.1 Permitted Use

You may use this website for lawful purposes consistent with these Terms. You may access and view the content of this website, contact us through available forms, and request information about our services.

3.2 Prohibited Use

You may not:

• Use this website in any way that violates applicable federal, state, or local laws or regulations.
• Transmit any material that is defamatory, offensive, or otherwise objectionable.
• Attempt to gain unauthorized access to any portion of the website or any systems connected to it.

5. Medical and Clinical Disclaimer

Nothing on this website constitutes medical advice, clinical recommendations, or a substitute for professional medical judgment. Prestige Wellness does not practice medicine and has no role in clinical decision-making. All prescribing decisions are the sole responsibility of licensed healthcare professionals. Patients should consult their licensed healthcare provider for all medical decisions.

Information about compounded medications on this website is for informational purposes directed at licensed healthcare providers only and is not intended for patients or consumers. All compounded medications available through the Prestige Wellness Platform require valid patient-specific prescriptions from licensed prescribers.

6. Third-Party Services

Prestige Wellness partners with third-party licensed 503A compounding pharmacies for medication fulfillment, payment processors for transaction processing, and other service providers to operate our platform. We are not responsible for the acts or omissions of these third parties. Your interactions with third-party pharmacies are governed by the pharmacy agreement executed directly between your clinic and the dispensing pharmacy.

7. Order Submission, Modification & Cancellation

Orders placed by a Participating Clinic through the Platform are transmitted to the applicable licensed 503A dispensing pharmacy immediately upon submission. Orders submitted before the applicable pharmacy's same-day shipping cutoff generally cannot be modified or cancelled once submitted. Orders submitted after the applicable pharmacy's shipping cutoff are scheduled for the next shipping cycle; Prestige Wellness will make a good-faith effort to request a modification or cancellation from the pharmacy, but this can never be guaranteed once an order has been transmitted. Fulfillment, return, and refund matters are governed by the pharmacy agreement between the Participating Clinic and the applicable dispensing pharmacy. Any concern regarding an order must be reported within twenty-four (24) hours of the order being received. This Section is provided for general informational purposes; Participating Clinics and their authorized users are subject to the complete order policy set forth in the Platform Terms of Use and Master Services Agreement.

We do not endorse, control, or assume responsibility for the content, privacy practices, or accuracy of any third-party website. Your use of third-party websites is at your own risk and subject to their terms and conditions.

The following disclaimers and limitations apply to your use of this website to the maximum extent permitted by applicable law.

9.1 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRESTIGE WELLNESS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS WEBSITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

You agree to indemnify, defend, and hold harmless Prestige Wellness and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of this website, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

11. SMS Communications

Prestige Wellness may send SMS text messages to authorized clinic contacts who have opted in to receive such communications. Message and data rates may apply. You may opt out at any time by replying STOP to any message. Our SMS communications comply with applicable TCPA requirements and A2P 10DLC registration requirements.

12. Privacy

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of this website shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you hereby consent to the personal jurisdiction of such courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
